GENERAL TERMS AND CONDITIONS 

These General Terms and Conditions apply to the contracting of the products (the "Product/s") offered to any Internet user who places an order (the "Client/s") through the website hosted at www.futbolemotion.com and www.futbolemotion.es (the "Website"), owned by the entity Sports Emotion Hub S, L., which operates under the trademark FUTBOL EMOTION® ("FUTBOL EMOTION").
The identification and contact details of FUTBOL EMOTION are as follows:

Transactions 

In order to proceed with the purchase of the Products, the Client must be registered on the Website, follow each of the steps of the procedure provided on the Website and add them to the shopping cart that will be generated as the products to be purchased are selected. However, the shopping carts are not binding for FUTBOL EMOTION or for the Client.
In subsequent contracting processes, once the Client has already registered, it will only be necessary for him/her to provide the e-mail address and password with which he/she has registered on the Website.
The Client must make diligent use of the credentials and not make them available to third parties, as well as immediately notify FUTBOL EMOTION of the loss or theft of the same or of possible access by an unauthorised third party. Price and method of payment.

The price of the Products shall be the price shown in Euros on the Website and shall include VAT and/or, where applicable, any other tax and/or duty applicable in the territory of application, as well as, where applicable, any shipping and customs charges duly broken down in accordance with the provisions of the Website: https://www.futbolemotion.com/gb/informacioncompra/envio#gastos. In the case of large orders, FUTBOL EMOTION reserves the right to modify the shipping costs of your order depending on the volume of the same, amounts that will be duly notified to the Customer immediately.
FUTBOL EMOTION reserves the right to make, at any time, the modifications it deems appropriate on the amount of the price of the Products. In any case, the price applicable to the order placed by the Client will be the one stated at the time of accepting the General Conditions of Contract for the selected Product.
The Client must make the payment of the contracted Products through the methods of payment provided on the Web. If applicable, the Client must include the payment information required in the purchase procedure of the Products.
Subsequent to such payment, the Client will receive an email confirming the purchase of the Product(s) together with a copy of the General Conditions of Contract. The Client may request from FUTBOL EMOTION a physical invoice for the purchase of the Product(s). 

Product delivery

Once FUTBOL EMOTION has verified that the purchase has been made correctly, it will proceed to deliver the Products to the address indicated by the Client in the purchase procedure within a period that, in no case, will be more than thirty (30) days following the date of confirmation of the order.
The Client may track the orders through the tool provided on the Website.
The delivery of the Products shall be deemed to have taken place from the moment they have been made available to the Client.
If at the time of delivery of the Products, the Customer is absent, he/she must contact the courier company contracted by FUTBOL EMOTION or the Customer Service Department to arrange another delivery date.
All orders for the purchase of Products are subject to availability. In case of unavailability of the contracted Product, FUTBOL EMOTION will inform the Customer and may offer him/her a product of similar characteristics of equal or superior quality, although the Customer, alternatively, may cancel his/her purchase and recover the amount paid as soon as possible. 

Liability 

FUTBOL EMOTION makes every effort to provide you with accurate and complete product information that is as up to date as possible. Notwithstanding the aforementioned, the color of the products that appear on the Website may vary depending on the characteristics of the Customers' devices. To this effect, FUTBOL EMOTION reserves the right to rectify the images of the products when necessary.
FUTBOL EMOTION will not be responsible for any errors that may occur in the delivery of the Products in the event that the Client has not correctly completed the purchase form provided on the Website. If there is any incident in the delivery of the Products, FUTBOL EMOTION will inform the Client as soon as it becomes aware of it.
The risk of the Products will be transferred to the Client from the moment they are made available to him/her and, in the case of their return, they will continue to be at the Client's expense until they are delivered to FUTBOL EMOTION.
Likewise, FUTBOL EMOTION shall not be liable for the non-fulfillment of any of the obligations derived from the General Terms and Conditions due to force majeure. 

Warranties

The warranty of the Products sold through the Website shall comply with the provisions of the legislation in force and, therefore, in general, FUTBOL EMOTION shall be liable for the lack of conformity expressed by the Client within three (3) years from the delivery of the Products.
In particular, if the Product offered by FUTBOL EMOTION is not in conformity, the Client must inform FUTBOL EMOTION as soon as possible by e-mail at customerservice@futbolemotion.com and follow FUTBOL EMOTION's instructions.
The Customer must follow, at all times, the instructions of the Customer Service and the provisions of the section "Warranties" to exercise the right of warranty.
In case of return of the goods due to lack of conformity, the return costs will be at the expense of FUTBOL EMOTION. 

Withdrawal

The Customer has a period of fourteen (14) calendar days from the date of purchase of the Products to exercise his/her right of withdrawal.
However, it is not appropriate for the Customer to exercise the right of withdrawal in the cases provided for by law, for example, in the case of personalised products or products made according to the Customer's specifications and in the case of sealed products that are not suitable for return for reasons of health protection or hygiene.
In order to exercise the right of withdrawal, the Customer must complete the Withdrawal Form and send the Product to be returned to FUTBOL EMOTION together with all the packaging.
Once the right of withdrawal has been exercised and, in any case, within a maximum period of fourteen (14) calendar days from the date of receipt of the Product, FUTBOL EMOTION will pay the Customer the full purchase price of the Product and, if applicable, the delivery costs.
Without prejudice to the right of withdrawal provided for above, FUTBOL EMOTION accepts the return of Products in accordance with the provisions of the Returns Policy.

Personal data protection

In relation to the personal data provided by the Client during the purchase procedure of the Products, FUTBOL EMOTION, in its capacity as Data Controller, will process them for the purpose of managing the sale and delivery of the Products contracted through the Website, as well as, where appropriate, to send informative communications to the Client by means of personalised automatised analysis.

Complaints and claims

The Client must contact FUTBOL EMOTION, through the means indicated at the beginning of the General Contracting Conditions, to express his/her complaints and claims, and FUTBOL EMOTION undertakes to make available to him/her the complaint form or sheet in order to attend to them as soon as possible and, in any case, within a period of one month from the time they are presented. 

Nullity

If any of the clauses of the General Terms and Conditions were to be declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall only affect such provision or the part thereof that is null or ineffective, and the same shall remain in force in all other respects, and such provision or the part thereof that is affected shall be deemed not to have been included in the General Terms and Conditions. For such purposes, the General Terms and Conditions shall only cease to be valid only with respect to the invalid or ineffective provision, and no other part or provision thereof shall be null and void, invalidated, impaired or affected by such invalidity or ineffectiveness. 

Applicable law and jurisdiction 

The General Terms and Conditions shall be governed by and construed in accordance with Spanish law.
In accordance with art. 14 of Regulation 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution in consumer matters, the Client is informed that they can submit their claims to the dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr/
Likewise, in the event that any conflict or discrepancy arises in the interpretation and / or application of the General Conditions of Contract, the competent Courts shall be those provided for in the applicable regulations on jurisdiction over consumers and users.

TERMS AND CONDITIONS OF THE SPORTS EMOTION MEMBER PROGRAMME

1. INTRODUCTION

These General Conditions (hereinafter referred to as the "General Conditions") govern the Loyalty Programme (hereinafter referred to as the "Programme") of SPORTS EMOTION HUB, S.L., with CIF B-50.907.229, which includes the following company brands

  • FÚTBOL EMOTION 

  • BASKETBALL EMOTION 

These General Terms and Conditions describe in detail the operation of the Programme, as well as the process of obtaining, redeeming and consuming Member Points (hereinafter referred to as "Points"). Members will have access at all times to the current version of the General Conditions in force by consulting the website of each of the SPORTS EMOTION brands in order to be informed of the conditions applicable to them as Members, which they declare to be aware of and accept.

These conditions may be modified unilaterally by SPORTS EMOTION.

Keeping an account as a customer implies full and unreserved acceptance of these terms and conditions.

2. PURPOSE OF THE PROGRAMME

The Programme is designed to reward SPORTS EMOTION customers for the purchases they make and the promotions in which they participate. In addition, members will be able to enjoy exclusive benefits with our partner brands.

3. PARTICIPATION IN THE PROGRAMME

The Programme is intended for individuals and is not available to partnerships, corporations, non-profit organisations, businesses, charities, companies or other non-individuals unless approved by SPORTS EMOTION at its sole and absolute discretion.

The Programme is based on the SPORTS EMOTION customer account created via the Website, the App or the physical shops.

Therefore, those who already have a user profile with SPORTS EMOTION will be automatically enrolled in the Programme without any additional subscription.

Membership of the Programme is obtained online, through our website or app, and in our physical stores, where users must provide the necessary personal data and consent to its processing for these purposes.

Each account is personal and non-transferable.

In case of doubt as to the identity of the Member, SPORTS EMOTION reserves the right to request proof of identity for verification purposes and, in the event of unsatisfactory verification, SPORTS EMOTION may decide not to award any membership points or other benefits associated with membership of the Programme and, where appropriate, to proceed with the termination of the account of the unidentified Member. In addition, SPORTS EMOTION may at any time refuse to issue or terminate an individual membership account if it has reason to believe that the account and/or the account holder has been associated with the following circumstances: abusive or offensive behaviour, theft, misconduct as well as the provision of false or misleading information.

Membership of the Programme is free.

To withdraw from the Programme, the SPORTS EMOTION account must be deleted.

4. MEMBER POINTS

Members earn 3 points for every euro spent on products. Members do not earn points for shipping costs paid on purchases.

5. HOW TO EARN POINTS

To earn membership points for online purchases, simply log in to your account.

To collect membership points for purchases made in physical stores or on Sports Emotion websites or apps.

Members of the Programme can collect points through the following actions: 

  • Purchases: for every euro spent at SPORTS EMOTION (both online and in-store), the customer will receive 3 points. Points are only awarded on the final price of the products purchased and do not include any other additional costs associated with the purchase, such as shipping costs.

  • Subscription to the SPORTS EMOTION newsletter: the participant who accepts the processing of his/her personal data for the purpose of registering as a subscriber to the SPORTS EMOTION newsletter and commercial communication plan will receive 100 points. Only one registration per user is allowed. 

  • Birthday: The participant will receive 600 points on the day of their birthday.

  • Participation in SPORTS EMOTION events: Participation in SPORTS EMOTION events can earn points.

  • Surveys: Filling in surveys we set up earns 100 points. Each product review is worth 20 points, with a limit of 10 reviews per year.

  • Profile completion: 100 points for completing all the fields in the profile.

  • APP: 100 points for downloading the APP. Updating the version of the APP can earn up to 100 points. 

SPORTS EMOTION also reserves the right to award additional points for other activities as specified, to multiply the points generated by Programme Members and to give points away.

SPORTS EMOTION may, at its sole discretion, exclude certain product purchases from generating points.

6. POINTS REDEMPTION AND ADDITIONAL REQUIREMENTS

Member Points can be redeemed in full for any online purchase and in any shop, unless the available Member Points exceed the amount of the purchase. It is possible that the points system may not work in certain shops or on certain websites.

Points can only be redeemed by the owner of the user account and only if the user is considered a 'normal user'.

7. EXPIRY OF POINTS ACCUMULATED 

The points generated and accumulated for purchases are valid for 6 months from the date of their acquisition. The date on which the points are obtained is considered to be the date of invoicing of the product that gives rise to the points, or the date of participation in events or other promotions that give rise to the points. SPORTS EMOTION reserves the right to set different validity periods with prior notice.

8. USE OF DISCOUNTS

Participants can use their discounts in both the online shop and the physical shops, except for the shops in Italy and Portugal, where points can only be accumulated and not redeemed. The store in Tarragona is completely excluded from the programme.

In the physical stores, it will be necessary to provide the account details for the corresponding points to be applied. 

9. PRODUCT RETURNS

When a purchase is returned, the Member Points used for the purchase will be refunded.

When a product is returned, the Member Points generated by that product will be cancelled.

If the points could not be cancelled in the above case because the customer has already used them on a subsequent purchase, the monetary amount equivalent to the Member Points generated and already used will be deducted from the money returned.

10. TERMINATION OF THE PROGRAMME

SPORTS EMOTION reserves the right to terminate the Programme at any time without giving any reason. Upon termination of the Programme, all Member Points shall be permanently forfeited without any possibility of recovery or reimbursement by SPORTS EMOTION.

11. LIABILITY

The Company is not responsible for any problems that may affect or disrupt the operation of the generation or redemption of points in the Programme. Furthermore, the Members shall be solely responsible for the use of the points or the use of the associated benefits and the Company shall not compensate the Members or be liable for any damages that may arise as a result of the Programme. 

12. APPLICABLE LAW AND JURISDICTION

These General Conditions shall be governed by Spanish law. The parties agree to submit to the jurisdiction of the courts and tribunals of SPORTS EMOTION's registered office for the resolution of any disputes, waiving any other jurisdiction.
